More so after collecting millions of ringgit from unsuspecting victims and industry players which includes contractor after alleging an ‘understanding’ with India’s Ministry of Railways and IRCON?

And claiming he bought expensive gifts and paid monies to the powers that be in Chennai and Delhi?

So Bala Devan – if you are reading this blog @and I am sure you are despite in hiding from impending Police arrest – please do not forget to get ‘future contracts’ (pun intended) even though despite all your wild claims and heavy money collection you were not able to deliver even a contract worth RM10/- and so much to your stupid claims!

A 30 page dossier on Malaysia’s lead conman and pathological liar, Brickfield’s Scott Road’s ‘Kannan’ or Bala Devan s/o A. Theaivendiram 57 has been handed over to the Home Affairs Minister and the Commercial Crime Head!

Next the Anti Corruption Agency will be briefed as well!

While – lead newspapers continued its coverage on this fraud urging to Police to apprehend this 57 year old who has cheated many individuals and companies!

Notorious  Bala Devan who is still at large had claimed he is connected to the powers that be both in Malaysia and India and in a position to give out various government projects packages and the Seremban to Gemas Double Track Project and the Malacca to Tampin and other rail jobs which includes the refurbishment of KTMB’s carriages!

To date it is alleged more than RM7 Million has been collected over the last 12 years!

A special dossier will be sent to the Indian Prime Minister and friends in the ruling Congress party through diplomatic circles as well to assist in this probe from their end!

The dossier will contain a comprehensive exposure of the various police reports against ‘Kannan’ Bala Devan Theaivendiram and other evidence – the more than a decade of fabrication, fraud, cheating, swindle that left a trail filled of innocent victims, lawyers, unemployed, contractors, industry captains, businessmen and women, and others!

This saga has moved in circuit linking Malaysia to India, its Ministry of Railway, the Railway Board, and the Tamil Nadu Chief Minister’s Office and in Malaysia the Ministry of Works and IRCON office at KL Sentral and KTMB!

It is a trail of deception, deceit, of lies.

It was a trail left behind by a professional conman and fraudster, a womanizer, smooth talker who speaks several Indian subcontinent languages!

Recently, there are also allegations that Bala Devan has being issuing threats against those who spoke out against him which includes me!

More Police reports are expected and pressure added to bring him to justice!

Instead of issuing death and bodily harm threats, Bala Devan should have the courage, decency and ethical value to face his victims and their mountains of documentary evidence and paper trail at Bukit Aman!

Instead of doing so he continues to run and hide for the coward he is and has been after ruining so many people’s lives and professions!

A living disgrace to friends and family!

1. Who gave him that confidential letter of award between Malaysian and India?

2. How did he get control of the total specifications, drawings, pricing of the entire Seremban to Gemas project which he attempted to sell at RM5 Million at one time but had no takers?

3. Who gave him the two letters claimed to be Ministry of Railway’s Railway Board letters? (See Blog posting part 4 on this subject) Was that leak from the Ministry of Work? 

4. Who gave him that recent letter written by Ircon International Managing Director to Malaysia’s Transport Minister?

5. Who is A.P. Misra and what is his role in all these allegations? Is he also a victim or a player? Who is this Daisy too? Who were his link in Ministry of Railways India and IRCON if any? What was Tamil Nadu’s role in this?

6. Who were the other directors of Zen Bridge Sdn Bhd and Era Phoenix Sdn Bhd with Bala Devan s/o A. Theaivendiram?

TOYOTA RECALL PART TWO – RAISES PERTINENT QUESTIONS ON QUALITY CONTROLS!

‘I am pleased to note the professionalism shown by manufacturer Toyota – where car-owners will be notified early in November, and the manufacturer will arrange for the brake master cylinder cup to be replaced with a newly designed version!

If more manufacturers and parallel importers can do the same in Malaysia instead of denials, arrogant stand-offs, lack of accountability and corporate governance – there will be less work for stand offs between us Consumer Advocates and the Industry!’ – Dr Jacob George.

TOYOTA RECALL PART TWO – RAISES PERTINENT QUESTIONS ON QUALITY CONTROLS!

I have just being informed that Toyota has announced a recall of more than 1.5 million cars worldwide over brake and fuel pump defects.

I am further advised that Toyota stated that the decision affected certain Avalon, Highlander and Lexus cars, including 740,000 cars in the US, 600,000 in Japan and 17,000 in the UK.

Toyota feels it is their corporate responsibility to ensure that fluid does not leak from the brake master cylinder, causing the warning light to turn on.

It is believed that this fault could cause the brake pedal to feel spongy and affect the essential and highly critical braking performance!

FLASHBACKS ON RECALLS PRIOR:

  • September 2009: Toyota recalls almost 4m vehicles globally on fears that accelerator pedals could become trapped in floor mats
  • January 2010: Toyota recalls about 2.3m vehicles in the US to fix potentially faulty accelerator pedals
  • February 2010: Toyota’s president apologizes to the US Congress and Toyota owners for safety problems that led to deaths and the worldwide recalls
  • April 2010: Toyota agrees to pay a record fine of $16.4m (£10.7m) in the US for failing to report defects
  • July 2010: Toyota recalls a further 700,000 mainly Avalon, Crown and Lexus models in two stages.
  • August 2010: 1.1m Corolla and Matrix cars recalled over an engine control system fault

However I am interested to know how Toyota arrived at a view that if the brake warning light is triggered, drivers still have another 200 miles to drive to find help before the brake performance deteriorates as it seems an ingredient to danger!

So far we are advised that the models affected are Lexus IS, GS and RX models built between 2003-2005 and in the UK!

For the record if you remember the US recall affects 2005-06 Avalon cars, 2004-06 Highlander (non Hybrid) and Lexus RX330 cars, and 2006 Lexus GS300, IS250, and IS350 cars!

The recall also affects 33,000 cars in continental Europe, 60,000 in China, 30,000 in Australia and 50,000 in the rest of Asia.

I am pleased to note the professionalism shown where car-owners will be notified early in November, and the manufacturer will arrange for the brake master cylinder cup to be replaced with a newly designed version.

The announcement follows more than 10 million car recalls by Toyota already in the past year, including 1.1 million Corolla and Matrix cars in the US and Canada recalled in August because of potentially faulty engine control systems.

Toyota has now issued 14 recalls in 2010.

The car maker was harshly criticized for not acting sooner over accelerator pedal recalls earlier this year, and was fined $16m by US authorities.

In the meantime are the vehicles on Malaysians roads safe?

BANK NEGARA PLAYS WALL STREET GAMES WHILE BORROWERS ROYALLY SCREWED!

‘Now why are the banks asking their solicitors to send out such unnecessary crude standard letters which are threats when their call centers and officials are already talking to the borrower and only by this course creating further financial bleed on the borrower that he can ill afford!

At worst the players within will manipulate the foreclosure with the touts outside and spring another financial killing for poor Kalaithason!

BANK NEGARA IN COMATOSE – BORROWERS ROYALLY SCREWED BY BANKS AND FINANCE COMPANIES!

CASE 1:

Kalaithason (not his real name) took a housing loan and has paid his monthly repayments regularly for 20 years until he lost his job.

He however managed to keep up with his repayments until illness hit him.

The banks directly and through outsourced call centers called him whenever there were arrears to be paid.

But the strange thing was despite his payments they added to his money problems by also instructing their solicitors to send out Letters of Demand which he paid for ultimately.

Now why are the banks asking their solicitors to send out such unnecessary crude standard letters which are threats when their call centers and officials are already talking to the borrower and only by this course creating further financial bleed on the borrower that he can ill afford!

At worst the players within will manipulate the foreclosure with the touts outside and spring another financial killing for poor Kalaithason!

And who addresses his woes?

Bank Negara? My foot!

Why is the said banks not showing the same kind of flexibility they show borrowers who are holding honorafics, are politicians or cronies of politicians?

After all here the sum is not in the multi millions where bail outs are politically initiated!

And how many house owners will lose out their homes and suffer emotional and anxiety filled meltdowns before someone out there really cares and intervenes to help!

Must hundreds of borrowers who have lost their homes ‘commit suicide’ outside Bank Negara before a level playing field one trampled with ethics, sensitiveness and care is initiated!

Case 2:

Rafidah bought a car and fell back on the repayments despite paying about 70% of the car price and loan!

Car repossesors were sent to harass her and grab the said vehicle causing great embarrassment to her and her family in their neighborhood!

The car was carted away by these thuggish looking men all ready to beat you up if you refuse!

Several weeks later she went over to redeem her car from the bank and yard only to find that the said car was scavenged of its various parts!

Shocked and upset the only way she could take the car back was through a towing service!

So that is what happens in the car yard – where your repossessed car is ripped off its vital and expensive parts thanks to sine biotic relationships between the various stakeholder in this crime both white and blue collar!

How else can this happen?

Again who addresses these issues without fear or favor?

Bank Negara? My foot again!

But I am glad that soon the Hire Purchase Act is going to be reviewed at this session of Parliament with a major amendment to it which will prevent the banks and lenders to pursue such draconian and vulgar reprocess schemes with the help of thirds parties, ‘the underworld and thugs!’

CONSUMER – NISSAN GRAND LIVINA NEARLY KILLED MY FAMILY!

‘We have always maintained that a strict duty of care exists that compels car manufacturers/ the industry to address consumer concerns, more so when it details safety standards and the possibility however ‘negligible’ of manufacturing defects!

In such situations, there is a need to address the concerns speedily and professionally and if the need be to call for a product recall so that a comprehensive and exhaustive investigation can be carried out in the public interest!

For the record, in recent times many a car manufacturer the world over have done so and it part and parcel of accountability, corporate good governance, ethical and basically putting the rights and interest of consumers above profits by denials!

And it may save lives!

I trust NISSAN would do the right thing in Malaysia!’ – Dr Jacob George       

CONSUMER – NISSAN GRAND LIVINA NEARLY KILLED MY FAMILY!

‘Good Day Dr Jacob

I am writing for advice on a matter that has caused my family and me many sleepless nights!

To summarize the problem, the brakes on my wife’s car failed as she was driving down from Genting.

The car is a Nissan Grand Livina, which was purchased a few months ago.

Thankfully, there were neither injuries nor an accident, as my wife managed to find a safe place to swerve into and apply the hand/leg brake.

She was assisted by two mechanics who managed to fix the problem – air in the brake hose, and even helped to drive the car down.

When the car was taken to Tan Chong, they checked the car and claimed all was okay with the car; and returned the car few hours later.

When I asked how such a thing could happen, I was told verbally that it could be due to air in the brake hose, but problem did not exist then.

After writing to them (last correspondence on the subject is attached for reference), they asked to have the car for another round of full inspections, with which we duly complied with.

After 3 days of testing/etc, they sent me the attached reply; which provides the full chronology of events.

I find their response non committal and insulting (added to the injury).

My wife and daughter are deeply traumatized by this incident and have been visiting a doctor in UH for assistance.

Even if what they claim is true (based on their formal response) I am wondering if other car owners who bought the same model are aware have had a similar experience which is traumatic!

Being a driver for the last 18 years, I have to admit I am fearful for the safety of my family.

This sad episode has incurred cost (medical), and the trauma caused to my wife and child cannot be quantified in monetary terms.

At the very least I belief I deserve a responsible / proper response with some form of compensation.

I would appreciate if you Dr George as Malaysia’s lead Consumer Advocate could assist to address not only the problems we faced but on a national footing whether there is indeed a necessity for a recall of this particular model for testing to protect other consumers?

My family and I look forward to your views on this subject in the public interest!

COCKROACH IN MY KENNY ROGERS MASHED POTATOES!

COCKROACH IN MY KENNY ROGERS MASHED POTATOES!

The KENNY ROGERS Customers says this:

Dear CASSA,

Hi there,

I would like to make a complaint about finding a cockroach in my mashed potato when I patronized at Kenny Roger’s at Tropicana City mall.

I would like to check what CASSA can do to protect consumers from such an irresponsible incident like that I have experienced!

I had attached here pictures I took when I discovered the cockroach in my mashed potato plus e-mail attached below between me and Kenny Roger’s administration on that matter.

Till today they did not come back to me with an explanation plus no compensation given for my losses.

Gosh we can understand the agony, anxiety, the pain and suffering, the trauma you are going through having repeated nightmares on the cockroach in Kenny Rogers served item!

But we also note that the said incident allegedly took place on the 23 of February 2010 and that you have also written to Kenny Rogers on the same and received a reply from them on the 25 February 2010?

For the record – we have spoken to Ms Cheryl Ng on the said matter today and she will revert to us.

If you check the Malaysian media or this blog you will notice that we have addressed such issues with serious commitment.

From our investigations and observations over the years we are quite surprised at the high tolerance level by Malaysian consumers towards dirty and unhygienic food outlets and street food!

So to see Consumers fight for safe and clean eateries and outlets we are happy!

We are also concerned that many of the kitchens where food is prepared are infested with various pests which include cats and rats!

As a result many consumers have suffered health risks and food poisoning and that statistics have arisen drastically over the years!

For some inexplicable reason – these complaints are not confined to the neighbourhood ‘Mamak shop’, School and government Canteens or under the Pine Tree Stall but to prestigious eateries in 5 star settings in hypermarkets, Malls and Food Courts and Hotels!

In your email you had indicated you suffered “losses” and wanted “compensation” and we would appreciate if you could provide us evidence of those claims accordingly.
