The notice of termination sent to the consumer reads as follows strangely even after they had paid the bill in full:

‘Tuan/Puan

Jumlah tunggakan yang dinyatakan di bawah merupakan jumlah yang perlu dibayar kepada Tenaga Nasional Berhad yang masih belum dijelaskan sehingga ke hari ini.

Selaras dengan Peraturan 4(1) dan 4 (2) peraturan Bekalan Pemegan Lesen (Pindaan) 2002, bil elektrik bagi jumlah yang perlu dibayar kepada Tenaga Nasional Berhad hendaklah dijelaskan dalam masa 30 hari daripada tarikh penyerahan bil bagi mengelakkan tindakan pemotongan bekalan elektrik ke premis tuan/puan.

Sekiranya bayan tidak diterima sebelum/pada 28.07.2011, Pemotongan Bekalan elektrik ke premis tuan/puan akan dilakukan mulai 01.08.2011 dan mana mana tarikh berikutnya sehingga jumlah tertunggak dalam notis ini dijelaskan sepenuhnya.

BAYARAN hendaklah dibuat melalui NOTIS ini di alamat Tenaga Nasional Berhad yang tersebut di bawah.

TNB boleh mengambil tindakan undang-undang terhadap tuan/puan di atas kegagalam menjelaskan tunggakan ini dan segala kos dan perbelanjaan yang terlibat akan ditanggung oleh pihak tuan/puan

SILA ABAIKAN NOTIS INI SEKIRANYA JUMLAH YANG DINYATAKAN TELAH DIBAYAR SEPENUHNYA.’

Several issues arise out of this rather rude and arrogant note that was sent.

First why was it sent even after the payment was made in full.

Second in this consumer’s case the amount outstanding then was a mere RM202.50 and not running into like the hundreds of thousands out of theft by organized syndicates?

That TNB is in a financial loss that is forcing them to cut the high salaries of its top management, staff and their perks and even perhaps face retrenchment?

Thirdly even if there was a breach would it not be proper to use the call center service or send a reminder to the said consumer rather than an arrogant bullish letter of demand as worded as this? The consumer could have been ill, dead, out of the country or the TNB bill may have never reached him which is in itself not uncommon in Malaysia!
Fourthly the deposit that was already in the hands of TNB worth RM470.00 for several years earning interests was more than sufficient to address this shortfall without addressing the matter in a crude and rude manner!

Fifthly TNB is a monopoly and she is in no way facing a financial meltdown neither will the recently passed toothless legislation the Competition Act will address this monopoly so why the tone of the letter in such legalistic manner?

Most importantly there are frequent electricity breakdowns causing economic loss to Malaysian consumers and how many consumers have to date filed or taken legal action against TNB for this failure?

We therefore today urge all Malaysian Consumers to TAKE NOTICE of all future breakdowns accordingly and initiate legal action by asking your solicitors to send a similar Letter of Demand for TNB’s failure!

Most importantly also initiate Police Reports the next time you get a TNB bill which is more than the exact usage!

If TNB wants to get legalistic in today’s political and economic climate – Malaysian consumers can also play the same game!

I think an apology is in order to the affected consumers and TNB needs to revamp its handling of these issues with more tact, sensitiveness, care and with public relations!

CONSUMERIST – MALAYSIAN EC TOLD LEARN FROM INDIA!

During a heated public forum today, Bersih 2.0 chairperson Ambiga Sreenevasan challenged the Election Commission (EC) to form a committee comprising of representatives from all political parties and NGOs to look into electoral reform and come out with a proposal.

Like other pertinent matters raised at today’s debate this also received a muted response which clearly showed without an iota of doubt that our EC is certainly tied to the umbilical cords of its political masters!

The fact remains with what he said and what he did not and his body language and other side references he made the entire three hours of the debate which convinced even the fence sitters that our EC was unaware of the powers they indeed had as per our Federal Constitution to make holistic changes which they have failed to, but, instead perhaps, treating the office as an extension of another government department?

Perhaps future EC positions should be filled from a wider non partisan group so as not to give the widely accepted perception now made conclusive that the EC are a group of ‘Yes Men and stooges’ given this position to spend their retirement years for their hardcore services rendered in their past government positions!’ – Dr Jacob George

CONSUMERIST – MALAYSIAN EC TOLD LEARN FROM INDIA!

Those of you familiar with Indian politics and have been to Chennai during the April 13 election as I had would have noticed the conspicuous absence of posters, banners, hoardings in the city, even though campaigning was at its peak for in Tamil Nadu.

This is in a stark contrast to its past elections. Tamil Nadu used to be known for its dominating, life-sized cut outs of political personalities dotting the landscape at poll time. The 2011 election campaign has done away with all that, thanks to the tough stand adopted by the Election Commission of India.

The distinguished Shahabuddin Yaqoob Quraishi, the chief election commissioner, without mincing his words, called Tamil Nadu the most challenging of all elections. Even before the polls began to the five state assemblies, he felt that not only “violence” would pose a big challenge in West Bengal and in Tamil Nadu, it would also be money politics.

But I was informed by many distinguished members of civil society that the April 13 election was in all aspects an Election Commission’s election, not one of Dravidian parties.

The EC was fiercely independent, accountable, professional and had a dedicated yearning to promote free and fair elections in the world’s largest democracy. They were not pussies pretending to be Tigers or proxies and cronies of incumbents and on the take.

Election rulings pertaining even to posters were strictly enforced, what more other fundamental issues to ensure fair and free elections.

The EC seized millions in cash after putting in place ‘flying squads’ to address corruption and abuse whenever a tip-off from the members of the public came in.

Well-connected politicians became so rattled by the EC’s tough stand that the chief minister  publicly attacking the EC for declaring what he termed as a “mini emergency” in the state.

When Finance Minister Pranab Mukherjee was in Chennai to release the Congress party’s manifesto, he skirted around the controversy by saying that he did not want to comment on the functioning of the Election Commission, mandated by the Constitution to conduct  free and fair elections.

That statement in itself was a powerful message of things that were to come and the change taking place for free and fair elections in the various states of India. An ordinary Inspector of Police stopped the convoy of GK Vasan, senior Congress leader in Dindigul, because there were more than the permitted four cars in the convoy.

The said Inspector who stopped the Congress convoy said he would have to be answerable to the EC if he allowed them more than the allotted number of cars in a convoy. It showed how seriously the State Electoral Officer, Praveen Kumar and his team, were taking to their jobs without fear or favor.

The EC’s fearlessness and heroic stories of ordinary officials doing their duty at considerable risk is admirable. Another story was in Tiruchy, where a woman official, a revenue division officer, equivalent to a sub divisional magistrate in the north on her first posting, had received a call in the dead of night, informing her of money being transported in a bus.

She immediately set out with her driver and office boy, picking up a couple of police inspectors on the way, and confiscated Rs 5 crores found in five bags on top of the bus. Voters were encouraged by the fact that the EC had got its act together even before the notification of elections.

In Madurai, a stronghold of Tamil Nadu Chief Minister Karunanidhi’s son, MK Azhagiri, the EC transferred four collectors and six police officials, among whom was superintendent of police. The new collector did not think twice about entering the house of Azhagiri’s lieutenants and checking on complaints filed against them.

The result – massive landslide victories all over and in Tamil Nadu.

New Tamil Nadu Chief Minister, J Jayalalitha, ascribed her party’s decisive victory in the polls to the people’s anger against the DMK regime and the EC for its fantastic job in ensuring a free and fair  polls.

In West Bengal, former Union Rail Minister, the fiery no-nonsense Mamata Banerjee won a landslide as well, and in Kerala another great result.

Kerala’s ousted chief minister was reported to have left on a bicycle refusing to use the official car for the drive home and agreeing to pay for whatever phone bill he had incurred during his tenure, from his pension.

Talk about politics of accountability!

Just imagine what the world of politics would be IF only ECs in different jurisdictions had the religious and mental courage to do the same rather than continuing to betray voters in return for various forms of gratuitous rewards and payments.

If someone tells me we will have a ‘early September middle October’ General Elections I will not be surprised!

I would welcome it as an opportunity to right a wrong, for me as a Christian to do what is right before GOD!

To clearly state that I cannot be tolerant of political pretenders, shenanigans, of untruths, lies, injustice, racism, abuse, corruption and it can go on!

CONSUMERIST – VOTERS REJECT CORRUPTION AND INJUSTICE!

It is just shocking the daily diet of liars, half truths, fabrications, spins, abuse, double talk that Malaysians are exposed to!

It is shocking when individuals continue to blatantly lie and distort and manufacture what they perceive and sell as ‘truth’ thinking the audience hearing or reading it are absolutely stupid!

Worst when one’s statement is changed a number of ways depending on the reaction of the audience accepting or rejecting it as false and manipulative!

Today information technology has provided a great resource to undermine and expose the shenanigans of politics who say one thing when they are abroad and another in the home front!

These days in a second information is transmitted to every end of the globe exposing political pretenders, self servers and basically parasites in expensive Italian silk suits living high profile lives with ill-gotten gains!

Last week I had the privilege of speaking to several hundred Christian  youths on ‘Politics and the Christian Call’ and I was very surprised at the depth of thought of my Christian brothers and sisters who were really equipped with the knowledge of the present political reality in the country and who had a word of advice to their Christian leaders telling them to – ‘Walk the talk as their leaders and not sell out for 30 pieces of silver!’

It was a great call and quite relevant in these days when various shades of truth is being pressured down our throats as each and every politician tries to sell their version of truth and justice!

And in every situation there are also those of us who repeatedly call for a pause a tolerance but do we tolerate injustice, liars, fabricators and blatant corruption!

As far as I am aware I say to my Christian brethren that tolerance when properly understood, is a virtue.

Go check out church history for one!

Historically, tolerance was demonstrated by refusing to punish or censure others because they held beliefs, opinions, or convictions different than our own.

Two people with opposite positions on a particular matter would be civil toward one another and allow each other to express their respective viewpoint without resorting to racism, intimidation, violence, or threat.

Inherent in the very concept of tolerance though was the assumption that the other person’s position was incorrect. It implies something is actually false or offensive to the one practicing tolerance.

Tolerance, as it is popularly conceived over the last twenty years, however, is self-refuting.

As far as I am concerned in 2011 the notion of tolerance means that you cannot disagree with someone without being criticized as “intolerant”. If you claim someone is wrong or misguided on a particular matter you will, ironically, quickly be censured. Just how did we arrive at this irrational view of tolerance?

On the other end relativism is the notion that each person’s view concerning knowledge or morality is equal.

And relativism makes the claim that you cannot insist that any belief or behaviour is wrong because no one has the truth. If this were really the case, however, we could not insist on tolerance either. And intuitively, we understand that not all beliefs and lifestyles are equal.

Everyone is intolerant when it comes to his or her most cherished values.

We are should and must be  intolerant of murderers, liars, wife beaters, terrorists, pedophiles, thieves, gang bangers, racist, and the like.

Depending on how serious a person’s vice, we either prosecute them, penalize them or avoid them—but we do not tolerate their behavior, by continuing to having them as our leaders nor should we. Isaiah 5:20-21

Tolerance, rightly understood, is a Christian virtue. Jesus would have us stand for truth and against falsehoods. Jesus wants us to practice doing good and oppose evil.

But unlike others who abuse holy scriptures this does not give us permission to harm others who disagree with us. But we cannot, in the name of tolerance, pretend to agree with those who disagree with us. 2Timothy 2:22-23 We can act in peaceful and civil ways to oppose those who oppose God’s Truth. But we cannot, in the name of tolerance, compromise either truth or righteousness as many have done before us and are today doing especially those who claim to be Christian politicians!

Jesus taught us to love our enemies. Matthew 5:44 So did the Apostle Paul. Romans 12:14 Both Jesus and Paul require a certain kind of tolerance for those who are intolerant of believers. But they are not telling Christians to lay aside their convictions and beliefs while “tolerating” those who view them as enemies.

So practice tolerance, but do not assume that tolerance means the acceptance of any and all behaviors or ideas. As Christians, we are called  to stand for truth, goodness, justice, mercy, love, and righteousness!

And this is why as Christians you are called not to be tolerant of murderers, liars, wife beaters, terrorists, pedophiles, thieves, gang bangers, racist, corrupt and lying politicians who claim they represent truth and you!

It was great news as far as I was concerned where colleagues in the US informed me that the World Health Organization (WHO) have banned blood tests designed to detect active TB are inaccurate!

More than two million such tests are carried out annually, but the WHO says they are unethical and lead to misdiagnosis and the mistreatment of patients.

Basically it is tests that is unnecessary but some part of the healthcare industry lobby enjoys the kickbacks and funding!

Interestingly WHO’s review of these tuberculosis test kits says they give wrong results in around 50% of cases.

This is shocking and should get the attention of countries that make up the developing world where most of this abuse takes place again!

And true that the said kits are mainly sold in the developing world.

No surprises that most of the 18 kits on the market are produced in Europe and North America.

WHO’s Director Dr Mario Raviglone is reported to have put it bluntly when he said that the the tests must be banned.

He said: “A blood test for diagnosing active TB disease is bad practice. Tests are inconsistent, imprecise and put patients’ lives in danger.”

The tests work by detecting antibodies or antigens in the blood that are produced in response to the bacterium.

But some of these commercial tests have what’s called “low sensitivity” which leads to large numbers of patients being told they do not have TB when they do.

Another WHO professional one Dr Karen Weyer added: “The evidence we reviewed over the past couple of months shows that one in two patients will be wrongly diagnosed, either [as] false negative or false positive.

“If it’s a false negative patients get the all clear when they in fact have TB, the disease continues to spread, and the patients may die.

“If, on the other hand, it’s false positive, patients are put on treatments unnecessarily while the true cause of their disease remains undiagnosed.”

“We would describe this as unethical – and we are making a very strong urge to governments to consider that TB is a threat and the use of these ineffective tests is also a threat.”

WHO now says that the tests which are manufactured in Europe and North America are prevented from going on sale where they are made due to regulations that call for extensive evidence of accuracy.

But this is not the case in the developing world – including in India and China.

CONSUMERIST – PAKISTANI DEATH SENTENCE FOR RAPIST FATHER WELCOMED!

There must certainly be joy in the heavens when a Pakistani court awarded the death sentence to a man for raping his 15-year-old daughter.

I was overjoyed to read that additional sessions judge Tahir Khan Niazi handed down the capital punishment after the charge against Khalid Amin was proved.

The issue was highlighted after Khan’s ex-wife Parveen Bibi had filed a first information report at Kahna police station in Lahore, accusing her former husband of raping their daughter for a month in 2009.

For the record Amin divorced Parveen in 2008 and the couple’s two daughters and four sons were living with the father.

The victim testified in court that her father raped her for at least a month.

Worst she stated to the learned judge that her father threatened he would kill her brothers if she disclosed his act to anyone!

The  entire saga was blown wide open after the victim had informed her cousin about the assault, and the cousin later informed the victim’s mother Parveen.

Perveen quizzed her daughter, who confirmed that she was raped by her father.

A few persons tried to assault Amin while he was taken out of the court but policemen protected him.

The persons called him a “savage” and demanded that he should be hanged at a public spot to make an example of him.

It is a pity that in many countries the same is repeated ‘day after day’ and in several cases the aided and abettor of the said offense is the wife who fears her husband will leave her or worst if that husband is a step father or lover and much younger than the woman silence prevails till a third party comes to the knowledge of the inflicted evil or the victims gives birth in strange and bizarre circumstances!

My own belief is that such perverse and evil animals should be castrated, flogged and publicly executed!

This irrespective of their wealth, social and political position in a country!

And those who aided and abetted the despicable act flogged publicly and returned to a mental asylum!

It is time we re-looked at these forms of perverse crimes against defenseless individuals!
