CONSUMERIST: ZERO TOLERANCE FOR CRIMINALS ATTACKING WOMEN!

The Consumers Association of Subang and Shah Alam Selangor (CASSA)today urged members of the civil society, residents associations, uniformed organizations and consumer groups to join forces to heightened awareness in our society to fight crime!

CASSA also calls upon the Police to declare a war on criminal and criminal activities to create a public space which is anxiety free!

Today the number of cases involving theft, robberies, attacks against women, children, burglaries is growing right before our eyes!

A month ago a retired 65 year of teacher was robbed when two robbers on motorbikes smashed her side screen and grabbed her handbag.

There have been cases where a similar situation has resulted in serious and grievous bodily harm even death!

To some it may be just statistics but to public interest it is a classic reminder that we are fast becoming a failed state if we cannot rein in the criminals on our streets!

Each time a handbag is stolen it involves important documents like identity cards, driving licenses, bank ATM cards, passports, credit cards, personal belongings which includes jewellery and cash!

Every time we approach the holiday or festive period there is a growing number of theft, robberies and attacks against women while onlookers watch without coming to the assistance of the victims!

These attacks are taking place at petrol stations, outside banks, shopping centres, eateries, despite the cosmetic presence of security and closed circuit television!

First of all we ask today who is conducting security checks to verify whether these closed circuit television are indeed working or that the human bodies that are walking around in uniforms masquerading as security guards are indeed trained and qualified?

There have been numerous cases when theft takes place and consumers enquire about the CCTV footage we are told by the management of high profile shopping centres, petrol stations and other public places that they are indeed not working!

On the 24th August 2011, at 6.30am at the Shell station at Kayu Ara PJU 6A a lady doctor was robbed while there was still several patrons at the petrol station.

The petrol cashier who was locked within had confirmed he noticed the presence of two individuals of a motor cycle monitoring the station several times looking at the patrons but he did not respond by triggering the silent alarm!

It is time these places also have an inbuilt alert siren to warm consumers and alert the authorities when there is a posibility of a crisis or robbery!

As a result the two robbed the lady doctor of her valuable causing deep seated trauma and anxiety when no one came to her aid!

Within 10 minutes of the said robbery the two robbers had attempted to withdraw from the victims ATM bank card at a bank suspected to be at a shopping arcade called Centerpoint in Damansara!

It was plain luck that when they grabbed her handbag her mobile telephone fell out and she was able to retrieve the said phone to alert the bank authorities and family!

The victim later made a first Police Report at PJ Police Station and later in the night was asked to go all the way to Mutiara  Damansara to file another report!

First CASSA is shocked at the incompetence of the Shell Petrol Station Cashier/Operator who failed to take such preventive measure as to avert a robbery!

Does a Petrol Stations, shopping centres, hypermarkets, or other service centres not have a duty of care to provide a safe environment for its patrons?

Secondly we are concerned at the apathy of those spectators who failed to come to the aid of this victim which gives encouragement to would be future criminals and robbers to continue striking fear on to the victims and continue their criminal acts against unsuspecting victims who could be one’s mother, wife, daughter, grandmother or other loved ones!

This morning CASSA appeals to all Malaysians to come to the aid and defense of victims if/when they see a theft or robbery taking place!

Create a situation of proactive response and involvement where you by your response tell criminals that any attack against any member of society will not be tolerated!

If you witness unusual behavior on the part of individuals in a public place or your housing estate alert the authorities immediately!

This morning CASSA also announces that we are initiating a pilot CASSA patrol of volunteers in the Klang Valley who are basically bikers hopefully numbering 500 who we urge to be on the lookout for suspicious individuals on motorbikes and to SMS the Police or us the location, description of the parties involved and registration of the bikes so that preventive measures can be initiated.

Secondly we are also urging the public to become involved in the public space so that they can be the deterrents to prevent criminal acts from taking place!

The robbery on August 24 that took place at the shell Station at Kayu Ara PJU 6A could have been avoided and should not go unchallenged!

Those who robbed that morning are serial robbers and CASSA urges the Police to conduct checks on the CCTV in the Kayu Ara and Damansara area which we believe would provide important information to the identity of the two who carried out the robbery!

CONSUMERIST: RISING ROBBERIES AND WOMEN VICTIMS!

‘It is time Malaysians of all walks of life come together in unity and address such cases instead of being spectators! !

It is time the Civil Society take it upon themselves to take on these robbers when we see them carrying out an attack!

If we are in our cars we should chase and run them down using our cars as a weapon! If we have protective gear in the car we should confront these rapid dogs to protect others.

If we can mobilize such civil action and response at the time of an happening instead of being a watcher or spectator and a no good deed doer then all is lost!

CONSUMERIST: RISING ROBBERIES AND WOMEN VICTIMS!

Yesterday at 6.30am my wife, a Malaysian doctor was attending to her car at a Shell Petrol Station in Kayu Ara PJU 6A, where she was robbed of her handbag with monies and personal documents by two Malay robbers on a motorbike!

Before 6.55am they had attempted to use her ATM card but failed at a bank close to the incident!

I am rather shocked that other patrons at the said Shell station never went to her aid!

How many times in the last 37 years have I put myself in harms way to address a wrong or fight for the rights, interests and needs of Malaysian consumers!

All for what (?) getting a bad name for not being like others ‘hunting with the hounds and running with the hares’ which gives you instant invitation to Malaysia’s Hall of Fame and various appointments and honorifics!

This sad and tragic incident was captured on Shell’s CCTV entirely how the two robbers had come into the station, done their observation round, parked just below the CCTV and waiting watching this doctor attend to her car before moving from two sides to steal her personal belongings in the car!

The rather shocked and traumatized woman was in tears when I spoke to her!

IF only I was there!

She had made a Police report in Petaling Jaya and later in the evening followed through with another report at Mutiara  Damansara this time, having me by her side.

I had alerted my friends at the Selangor State Police Contingent and Bukit Aman and am thankful for their speedy response and support!

I had got the Shell petrol Station to download the incident and copied it providing a copy to the Police for the Forensic Team to comb it as I am certain these were serial robbers and targeting helpless women!

The incident is uploaded also in face book and You Tube so that members of the public can help Police with the identities of the two and at the same time be educated on the ‘do and don’ts’ by this incident!

I am sad that my wife was a real soft target and wished I was by her side when this incident took place it would be great to see if these ‘rabid dogs’ have the courage to take us on then!

If we do not then we can read in many Travel Advisories such things being stated about Malaysia:

  • Credit card and ATM fraud is widespread. Take great care when making payments by credit card and using ATMs. There have been many instances where cards have been duplicated and skimming devices added to ATMs.

Then, it is no point for our ‘Wisma Putra boys and girls’ to scream unfair international wire or report – it is time to clean up Malaysia and allow our boys and girls in blue to do their job by assisting them with higher salaries, support service, infrastructures and resources!

And a word of caution to the politicians:

It is time you allowed the Malaysian Police to carry out their jobs professionally instead of interfering and frustrating their efforts to curb crime!

CONSUMERIST: PSC – EMERGE NOW POLITICAL PRETENDERS!

I was among the first to laud the announcement by Premier Najib Tun Razak on his decision to initiate a Parliamentary Select Committee (PSC)!

It was a great statement and timely, but short lived!

The truth is when I was interviewed by both the local and foreign media, I had my doubts on the PSC without first fundamental changes to the National Registration process, the composition of the Election Commission and the allegations of citizenship for vote and the 3 million Indonesians and 1.67 Filipinos issue that rocked our nation recently which resurrected with Mishmahgate but had its ugly ghost in Sabah!

But I was willing to be proven wrong, willing to eat humble pie if my observations and claims then were proven wrong!

After all I am a just an ordinary, simpleton and ‘boy scout’ consumer advocate  (as one referred to me!) – a no body in the power circles of media, politics and industry?

But since that first announcement by the Premier the statement has been muddied by many players each departing from the noble notions of the PSC eventually rubbishing a statement that was truly very statesmanlike!

And this ordinary, simpleton and ‘boy scout’ consumer advocate who has been repeatedly bypassed because he speaks the truth and refuses to hunt with hounds and run with hares was right again!

That is the state of Malaysian ‘kiss-ass’ politics!

And it became so muddied that the maker of such a great timely statement had to eventually make a ‘u-turn’ with another statement that virtually gives a perception that this is yet another flip flop!

Since then we have ‘new actors and political pretenders and opportunist’ some among them already known to ‘have hunted with the hounds and are currently also running with the hares’ making statement that borders on absolute stupidity!

The bipartisan voices of the civil society those who are truly independent and politically clean are now accused of being ‘hostile’ towards the Election Commission!

One had the audacity to tell us that the EC is ‘open minded and honest’ and if that was the case why did they go on a demonizing individuals striving for free and fair elections by and post July 9th?

Why did they in two gatherings and in several interviews and reports with a racist vernacular newspaper attack the same civil society individuals in a malicious manner unheard of by a EC in any constituency the world over confirming a widely accepted notion that they are stooges nothing more!

There is a perception that they are mere parasites and simply the political hatchet men and women, specially selected by the powers that be for their long sustained benevolent and unflinching servitude to the political powers that be!

The essence and truth of it all is as rightly pointed out by my learned friends that the parliamentary select committee (PSC) on electoral reform would be pointless if we go ahead with the general election, as parliament would in this case have to be dissolved!

Only again, the cart is before the water-buffalo!

How then will we address the fraudulent practices in the electoral processes.

As widely accepted by over 12 million potential voters that there should first be a clean-up of the electoral roll, a decision made on the use of indelible ink, the automatic registration of voters, the reform of absentee voting, and a minimum 21 days campaign period to be implemented!

Should we not address the other larger issues of elections and democracy such as electoral system, a full review of all electoral laws and the composition of the Election Commission, a realignment of the parliamentary seat boundaries so that the ‘one man one vote is not compromised’ with then all votes count the same and importantly a code of conduct for elections with the power of law passed, monitored and observed by the EC like in India!

CONSUMERIST: ELECTIONS – TIME TO ENTRENCH CODE OF CONDUCT!

The Election Commission is some countries are mere brainless stooges!

They confirm it the moment they open their mouths and issue statements sounding like politicians rather than statesmen and women selected to uphold honor and justice!

They are worst than mere parasites and simply the political hatchet men and women, specially selected by the powers that be for their long sustained benevolent and unflinching servitude to the political powers that be!

Some may call them ‘mere running dogs’ but I will not go that vulgar!

But in some countries the Election Commission do justice to their selection and appointment and to the merits and tenets of democracy!

One such Election Commission is the Indian Election Commission!

And why do I say so!

I had witnessed them in action not only in the last Election in 2011 but also in 2004 and the manner they carried out their task was just superb!

Whether you know it or not there is a model code of conduct and its values are universal provided your intentions are noble, ethical and serving the free and fair election module!

And how does it operate?

Did you know that in 2004 Deputy Indian Prime Minister L K Advani flew in an Indian Air Force helicopter from Bangalore to Tumkur in Karnataka to address an election meeting.

By the time Advani had completed his speech, the Election Commission had announced the dates for the general election and enforced the Model Code of Conduct for parties and candidates.

Advani was thus compelled to send the helicopter back and return to Bangalore by car.

Such is the power of the Model Code of Conduct.

The Election Commission through its Code of Conduct monitors the behavior and actions of the political parties and their candidates in any elections! They do not give excuses that they are powerless, they do not behave like ‘sissies and cry babies’ or stating that they are merely a ‘administrative management body!’

1. What is the Model Code of Conduct?

It is a set of guidelines laid down by the Election Commission to govern the conduct of political parties and candidates in the run-up to an election.

2. What is the need for such a code of conduct?

It is intended to provide a level playing field for all political parties, to keep the campaign fair and healthy, avoid clashes and conflicts between parties, and ensure peace and order. Its main aim is to ensure that the ruling party, either at the Centre or in the states, does not misuse its official position to gain an unfair and vulgar advantage in an election.

3. When does it come into force?

The Model Code of Conduct comes into force the moment an election is announced and remains in force till the results are declared.

In 2000 in India, there was a tug of war between the central government and the Election Commission on the Model Code of Conduct.

The government went to the Supreme Court against the Commission’s ruling that the code of conduct comes into force the moment elections are announced. The government insisted it should be enforced only from the date of formal notification of each phase of election.

The Election Commission called an all-party meeting to settle the row. Eventually all parties, including the ruling Bharatiya Janata Party, agreed unanimously to support its stand on the Model Code of Conduct.

4. To whom does the code of conduct apply?

It applies to all political parties, their candidates and polling agents, the government in power, and all government employees.

5. So what does the Model Code of Conduct mean for a ruling party?

Then again in India in 2004 Ministers, including Prime Minister Atal Bihari Vajpayee, were not allowed to combine their official visits with electioneering work. They also cannot use official/government machinery or personnel for electioneering work. Public places for holding election rallies and helipads for flights in connection with elections are to be made available to all parties on the same terms and conditions on which they are used by the party in power.

6. Can ministries sanction grants out of the government’s discretionary funds during election time?

No. Ministers and other authorities cannot sanction grants and payments out of discretionary funds from the moment the elections are announced.

7. Can the government run an advertising campaign in the mass media?

Advertisements at the cost of the public exchequer or in some countries using the Ministry of finance and misuse of official mass media for partisan coverage during an election have to be scrupulously avoided.

8. What are the other guidelines for ministers and other government officials?

Ministers and other government authorities should not announce or promise any financial grants to the people; they should not lay foundation stones for or inaugurate any projects; they should not promise public facilities like roads; and they should not make any ad hoc government appointments.

9. How do candidates and parties campaign when the code of conduct is in force?

Parties can issue its manifesto detailing the programs they wish to implement if elected to government, the strengths of their leaders, and the failures of parties and leaders opposing them. They can use slogans to popularize and identify parties and issues, and they can distribute pamphlets and posters to the electorate. They can hold rallies and meetings where candidates can persuade, cajole and enthuse supporters, and criticize opponents. Candidates can travel the length and breadth of the constituency to try to influence as many potential supporters as possible.

10. Can parties/candidates hold meetings wherever they want?

Yes, but the party or candidate has to inform the local police authorities of the venue and time of any proposed meeting well in advance to enable them to make necessary arrangements for controlling traffic and maintaining order.

11. Can parties call for votes on race, religion and communal lines?

No. The Model Code of Conduct strictly prohibits parties and candidates from making any appeals to caste or communal feelings for securing votes. Mosques, churches, temples, and other places of worship also cannot be used for election propaganda. No party or candidate can indulge in any activity that may aggravate existing differences or create mutual hatred or cause tension among different castes, communities, religious or linguistic groups.

12. Can parties criticize their opponents?

Yes, but the criticism of other political parties should be confined to their policies and programs, past record and work. Parties and candidates should refrain from criticism of all aspects of private life not connected with the public activities of the leaders or workers of other parties. Criticism of other parties or their workers based on unverified allegations or distortions should be avoided. Worst they should not use third parties to orchestrate all forms of allegations and gutter politicking!

13. What happens if a candidate or party does not obey the Model Code of Conduct?

The Election Commission has warned that any breach will be dealt with sternly. The Commission has the power to disqualify a candidate if s/he refuses to follow the Model Code of Conduct.

I salute the Indian Election Commission again for their commitment to democracy, fair play, accountability, good governance, transparency and zero tolerance for corruption and corrupt practices and not succumbing to direct and indirect attempts by the powers that be to manipulate and taint them!

‘The truth is and take it from me!

IF this is the strategy to win back lost states, the hearts and minds of Malaysian voters – do not bother as Malaysian voters are very well aware of the issues involved be it of allegations surrounding ‘instant Malaysian citizens’, the concerted bashing of minorities, attacks on religious buildings, policies, phantom and cloned voters, alleged proselytisation, the racial and religious bigotry fermented by certain political thugs and goons, ‘whether the Malaysian Election Commission is bipartisan, professional or brainless stooges, flip-flop policies, the amnesty program, the various monopolies and takeovers, the alleged abuse of the EPF and government appointments!’ – Dr Jacob George

 

CONSUMERIST: NON MUSLIMS WELCOME PAS STATEMENT!

I have just returned from my home town Penang where for over a week I conducted several surveys on race relations, the political climate, the economy there, tourist arrivals, and on Penang voter sentiments!

But while I will withhold my findings for the moment I cannot but applaud the statement by PAS to a certain group not to be entrapped by the attempts of extremist groups to create a climate of fear in Penang.

Yes it is obvious that there are certain groups out to create mischief and these are not a majority but a handful of repeat recycled political artiste and mercenaries creating a siege atmosphere aided and abetted by a racist vernacular electronic and print media!

And I am thankful to PAS vice-president Mahfuz Omar who I have great respect for urging parties in this holy month of Ramadan to demonstrate the true virtues of one’s faith and its righteous teachings to non-Muslims.

That one should reject any attempts to sow fear through extremist measures advocated by certain groups such as vandalizing places or making racist remarks!

That one should not and in fact never should one antagonize one another to raise the level of suspicions in the country.”

I must commend Suadara Mahfuz who rightly stated and quite evident in my observation as well that since 2008, there have been attempts to instil fear and create divisions within a multi-ethnic and multi-religious society.

Like I said it is sad that among the perpetrators of this onslaught was a certain vernacular mainstream newspaper and a TV station and politicians who cannot accept that the voters have rejected them and even voters from their own camp!

Of late – there have been a series of demonstrations, but the last one in Penang caused traffic havoc on Penang Bridge, great fear, anxiety and logistics nightmares and interestingly, where a despicable ‘political mercenary’ took part!

Interestingly, the same individual has also uttered seditious statements, threatened harm and the criminal destruction of two new portals after last Friday prayers here!

We are told that he is a new senator of the ruling party but senators are expected to be upholders of the law are they not?

They are supposed to be role models for the nation, our young school going children, our undergraduates, but is he?

A week has passed and has he being questioned by those expected to uphold the law and maintain order in the country?

The last time I checked, we still had laws on sedition, public order, criminal intimidation, arson just to add a few!

So is he an untouchable and above the law?

Interesting perception, we give to the grassroots and over 12 million voters!

It is a shame that even after 54 years of independence we cannot afford to respect one another and most importantly, voters decision!

So what is ‘the message’ from the arsonist and those totally irresponsible people who attempted arson of the Penang state DAP headquarters at Jalan Talipon after certain state issues were again manipulated by political forces for a political agenda!

The truth is and take it from me – if this is the strategy to win back lost states, the hearts and minds of Malaysian voters – do not bother as Malaysian voters are very well aware of the issues involved be it instant Malaysian citizens, the concerted bashing of minorities, attacks on religious buildings, policies, phantom and cloned voters, alleged proselytisation, the racial and religious bigotry fermented by certain political thugs and goons, ‘whether the Malaysian Election Commission is bipartisan, professional or stooges, flip-flop policies, the amnesty program, the various monopolies and takeovers and government appointments!

And no amount of feel good programs, talk shows, tweets, political rhetoric, radio advertisements on our national day, flying the flag and unity can change this sentimental on the ground unless and until there is true reforms that one can believe in not cosmetic statements often rebutted immediately or drowned by individuals/politicians from ONE’S OWN POLITICAL CONFIGURATION!

Gosh, that sucks big time!
