So far the behavior of Zaharie fits perfectly, to the DNA shared by peers and friends as a very sensitive and caring person, going out of his way to help others!

And certainly – Yes, Fatima Pardi had been interviewed four times by investigators of flight MH370 and knowing how law enforcement agencies work in my part of the world, I can safely say there was no smoking gun there!

Honestly, I did not know buying gifts for children were behavior patterns and sweeteners to “soften the ground” before the good captain decided to physical crash land on the mother?

But then, Fatima Pardi herself went on record that they were not having an affair and her decision to speak on this matter publicly was because she wanted to counter speculation that Zaharie might have hijacked the plane as a fallout of their relationship!

The last time I checked, it was not improper for anyone to show common decency, loving kindness, sensitiveness, towards widows, children, others, and by those unmarried and to those Muslims who are allowed to take more than one wife subject to guidelines, what is wrong morally if indeed there were discussions in that vein?

The fact is those of us in the civil society, in politics, public office, or whatever vocations, in whichever country we are in, addressing pertinent issues of society and state, either through dialogue, forums, peaceful assemblies or demonstrations, provide platforms for discussion to the common folk on the challenges, we face in society and how to address them as in a democracy!

As such, silence is not an option!

This is how true democracy works, when we stand up for or against, a cause, person, institution or political abomination.

The very ability to platform a debate or public discourse or rebuttals is how true democracy is realized.

It is our responsibility, our right and duty!

I am of the opinion that, the second, public interest opinion stops, is sidelined, being produced with debates and discussion dying, it results in the death of true democracy.

It is my prayer, that we will never have a culture of silence, as a result of gross direct intimidation, the utilization of the politics of fear, sometimes through outdated draconian statutes initiated by enemies of true democracy, and truth is silenced.

I am aware that, it is a fact, that there are times that individuals are silenced out of trepidation, of what is to come, a ghost like terror of ostracisation, political persecution or character assassination!

The result – a collective and consuming fear of persecution is normalized and as such, silence breeds further silence, at any and all injustices, abuse of power and types of corruption, that takes place in society.

It is scandalous that Malaysia allowed Mahinda Rajapaksa, the former president of Sri Lanka who is held responsible for the deaths and disappearance of hundreds of thousands of Tamils, many of them children, and the rape and sexual abuse of Tamil women during the civil war that ended in 2009 to Malaysia and for an audience with Malaysia’s Prime Minister!

Malaysian Indians are aware of this and the anger, agony and hurt runs deep within for the lack of sensitiveness again shown to the community who have been part and parcel of our pre and post-independence struggles and nationhood to date!

While I condemn the assault on the diplomat, as a political analyst, I believe the recent protests organized by a number of Tamil groups in Kuala Lumpur had a dual purpose one to show their displeasure at Mahinda Rajapaksa presence and secondly, towards the Malaysian government for being insensitive towards Tamils in Malaysia!

To suggest anything more, by any quarter without data, facts, intelligence, is paranoia, misrepresentation, idiocy, and simply a lie!

As I predicted last week to the local and international media observers – the alleged crane operator, presumably an Indonesian, who allegedly caused the death of a Malaysian 24 year old lass has fled the country!

There are allegations that his illegal presence and operation of a crane saw 24-year-old Chin Khoon Sing crushed to death, after a 500kg crane hook fell 20 floors and slammed into her Perodua Kelisa!

Without any sense of shame or embarrassment, we are asking Interpol for assistance!

Yes, as an attorney with decades of experience both national and international, I am aware of the Interpol’s Red Notice list – an alert notice against a person wanted by national jurisdictions for prosecution, or to serve a sentence based on an arrest warrant or court decision.

But this is stupid and silly and will have no impact on Indonesians!

These people are currently walking in and out of the country as are criminals and terrorists and more recently even South American thieves!

So much for bio metrics, fingerprinting, and multi million ringgit tax payers monies spent on hardware, when the areas most needed to address is the “software?”

Meanwhile, all Malaysia’s Department of Occupational Safety and Health (DOSH) can say is that they are in the midst of conducting a probe into the incident, and refused to divulge information on the action to be taken against the construction company and the contractor who supplied the crane.

Even, the construction company in the midst of this scandalous and heinous crime confirms that all work on the project has been suspended, pending investigations by the authorities.

What is pending?

Should there not be a charge against the directors of the construction company, those who had a duty of care to act within the requirements of o failed miserably causing the untimely and tragic death of a 24 year of Malaysian?

Or as is the norm, there will be a drama unfolding of a stop order, while certain high powered politicians and others walk the telephone lines, there are meetings at prestigious hotels over many rounds of drinks and food, with several rounds of massage at a well-known SPA, followed by bodily service to remove great stress from where the brains are for many these days in powerful positions in Malaysia – I mean – below their navel by young Indonesian, Vietnamese, West Asian, Chinese prostitutes, or Caucasians and a bag of monies change hands pushed under the table?

We now have a DOSH Director-General Mohtar Musri as saying his department had about 80 workers in Kuala Lumpur — 20 administrative and 60 technical employees!

That twelve of the 60 are tasked with inspecting construction sites while the rest monitored factories and other types of workplaces.

The facts speaks for itself!

Is this not a criminal offence that we are having or approving 600 construction sites in Klang Valley alone, when we do not have the professionals, enforcement personnel, and stakeholders needed to maintain a sharp surveillance over the various processes so that the tragedies we hear so often are at best minimized?

Where is public interest protected in all these?

What has the NIOSH Chairman done in all these issues?

So spare me the bullshit maneuvers and delayed reactions of now investigating the crane accident.

Now who was that crane operator, his identity, was he qualified, licensed, who ran for his life knowing clearly the implications of his actions, omissions, crime and those around him in vicarious liability!

The last CASSA LAWYERS checked our statutes the law requires this person to be a Malaysian and the crane is not supposed to operate outside the hoardings on the building, especially in the space above public roads. The crane must also be properly certified.

Most importantly that contractor and the workers must also be certified by CIDB.

In the public interest, checks must be also made on the various scaffolding and audits on the safety housekeeping practices at the work sites
