I cannot but seek the answers my learned friends from – NGO Lawyers for Liberty (LFL) raised:
Does the present judgment then give the police a ‘carte blanche licence’ to kill anyone fleeing from the police even if they are not suspected of any serious criminal offence nor pose a threat to members of the security forces or public?
Does the judgment then give the perception that the Malaysian courts now support trigger-happy police whose action can be continued to be stated as ‘mistake or accidental death?’
Is the Malaysian courts not interested to address the pertinent issue of ‘international and established standards for the use of lethal force’ specially when minors and unarmed are involved?
More importantly, has the Malaysian courts failed to look into whether Jenain’s actions were justified under the law and in accordance to the police’s Inspector-General’s Standing Order on the use of firearms?
What troubles me and all parents in 1Malaysia – Sabah and Sarawak included – that the Malaysian courts had held that the 30 shots fired from a sub-machine gun were meant to stop the vehicle with no intention to kill Aminulrasyid?
That is scandalous to put lightly!
Does that mean we now have a precedent set in 1Malaysia that one can spray any fleeing vehicle with bullets and when death takes place hold no one accountable?

And that finding be made globally public and a standard of dignity, decorum, the rule of law and for law and institutional behavior reforms worldwide?
